CMF issues regulation with instructions on submission of requests and resolutions of judicial procedures under Law No. 20,009

The regulation governs information that financial entities are mandated to report to the CMF regarding judicial requests for suspension of charge cancellations or fund restitutions carried out under Law No. 20,009, and the sentences that apply to them.

November 29, 2024 - The Financial Market Commission (CMF) issued today General Rule No. 523, which establishes instructions on submission of information regarding judicial requests for suspension of charge cancellations or fund restitutions carried out under Law No. 20,009, and the sentences that apply to them.

The report must include a copy of the corresponding request and, subsequently, a copy of the enforceable judicial decision terminating the judicial proceeding.

The regulation establishes that said information is to be submitted monthly through the "CMF Supervisa" module pursuant to the regulation's Technical Annex available on the CMF website. It becomes effective as of today, but entities must begin reporting filed applications and their enforceable resolutions starting on June 1, 2025. The first report is due within the first five business days of July 2025.
