August 9, 2023 - The Board of the Financial Market Commission (CMF) issued a series of sanctions to several entities due to their non-compliance with ongoing information reporting duties. Per Exempt Resolution No. 5,387, El Torreón SADP was fined with UF 90 due to not sending its 2021 Annual Report and quarterly financial information for June 2022 to the Commission. This constitutes a breach of General Rule No. 201, which regulates ongoing reporting obligations for professional sports corporations.
Exempt Resolution No. 5,386 applied a sanction of UF 35 to Empresa de Agua Potable Melipilla Norte S.A., as well as censuring Sociedad Concesionaria Ruta de la Fruta S.A., Explotaciones Sanitarias S.A., and Los R S.A. for not submitting their ongoing information within the timeframes stated in General Rules Nos. 30 and 364.
Fábrica y Maestranzas del Ejército failed to submit its financial information for the timeframe between September 2020 and July 2021, per Exempt Resolution No. 5,388. Said entity was fined UF 75 for breaching the General Rules mentioned earlier. Fondo de Infraestructura S.A. did not send its information for March 2021, which earned it a censure.
All these sanctions were issued after simplified sanctioning procedures, which are governed by General Rule No. 426 and Articles 54 and 55 of Decree Law No. 3,538.
The three Exempt Resolutions stress the importance of the obligation to submit ongoing information for professional sports corporations and entities enrolled in the Special Registry of Reporting Entities. Said information allows the CMF and the public to know the financial situation of these companies.
