November 15, 2023 - In an extraordinary session held today, the Board of the Financial Market Commission (CMF) agreed to file charges for alleged bribery against Luis Hermosilla Osorio, Daniel Sauer Adlerstein and María Leonarda Villalobos Mutter. The decision is based on the background information stated in an official communication of the CMF's Investigation Unit which deals with an audio recording received anonymously on the afternoon of November 13. The recording's contents were partially published later on by a national news outlet.
At the same time, the Board agreed to support the decision of CMF Chairwoman Solange Berstein about carrying out an internal investigation to determine possible administrative infractions and the pertinent penalties. The Board sees the act of trying to influence the decisions of public officials through payments or favors, as well as their request or acceptance, as an extremely grave conduct. It also stresses that the actions of the Commission and its personnel are based on collegiate decisions and exclusively technical criteria to safeguard objectivity and probity.
Regarding STF Capital Corredores de Bolsa S.A. and its upper management, comprised of directors Daniel and Ariel Sauer Adlerstein, and general manager Luis Flores (all sanctioned with maximum severity by the CMF); and Factop Corredores de Bolsa de Productos S.A., whose operations are suspended, the Board states categorically that the Commission's actions on these matters has featured full probity, transparency, and diligence. The record of its decisions and the grounds thereof is also available to the public.
The Board is at the full disposal of the Public Prosecutor's Office in the investigation it has launched.
